Chile:

A young man living with Aids wins his
Lawsuit against a medical center due to discrimination

Punta Arenas, Chile, Terra.com – A decision by the Second Court of The Local Police in Punta Arenas sentenced a health care company in this city to pay 200 monthly tax payments, about 6 million pesos, to a young man who accused the company of denying him medical services because he had been diagnosed with the HIV virus.

The plaintiff, who is currently 23 years old, was attacked with a knife and sustained serious injuries during an incident that happened last year at the end of June, and sent to the medical center where he was medical attention.

The verdict by the Judge of the Second Court of the Local Police, Patricia Espinoza, established that discrimination took place on behalf of the medical personnel, who denied him treatment once they found out he was an AIDS carrier, they opted to transport him by ambulance to the regional hospital.

Fred Facusse, a spokesperson for the medical center that was sued, stated that they were notified of the decision and that they will file an appeal./ Back to top


Human Rights Watch:

Defends the rights of the LGBT communities

Nueva York, GLADD. -Aiming to permanently fight human rights violations due to sexual orientation or gender identity, Human Rights Watch has started a Human Rights Project for lesbians, gays, bisexuals and transgendered.

Human Rights Watch is a human rights organization that conducts researches and offers political recommendations. Through supervision, information and campaigns, Human Rights Watch has promoted fundamental human rights in more than 90 countries for 25 years.

While developing the project last March, Kenneth Roth, Executive Director of Human Rights Watch, visited Cairo to release the report on the persecution of men suspected of having sexual relations with other men in Cairo. The report is titled  “In A Time of Torture: The Assault on Justice in Egypt’s Crackdown on Homosexual Conduct”.

The Human Rights Project is developed under the supervision of Scott Long, who reported that Human Rights Watch has been lobbying extensively with the Egyptian government, as well as with European and American leaders in order to stop the arrests.

He added that during March and April this initiative was in Geneva, Switzerland, in the United Nations Human Rights Commission and in the International Gay and Lesbian Human Rights Commission (IGLHRC), along with other organizations from several countries promoted the participation and attendance of activists during these sessions, who spoke about the Commission’s sessions about abuses due to sexual orientation and gender identity. Brazil orders the inclusion of a homosexual’s
partner in health Insurance

Sao Pablo, AFP– Last July, the Civil Chamber of the State Court in Sao Pablo, ordered 15 health insurance carriers to include “homosexual partner” as a dependent of the insured within 60 days, just as it shows for heterosexuals.

Although a civil chamber made the decision, the decision applies to all the regions in the country, stated a spokesperson for homosexual organizations in Sao Pablo.

The spokesperson added that the Justice Court in Sao Pablo, which is made up of senior judges, could reverse the decision. However, everyone expects the decision to stand. 

Homosexuals in Brazil, through their organizations, have been gaining a lot of rights in the courts in various states, such as the right to an inheritance or a pension. 

Last March, the state communications company, ‘Radiobras’, decided to extend to homosexual partners of its employees the same labor rights as the spouses of heterosexuals./ Back to top
